The Labour court has restrained Kenya Airways from advertising, recruiting or carrying out interviews for the position of group finance director following a suit by Alex Wainaina Mbugua, who formerly held the position.
Mbugua wants the court to reinstate him to the position, pending hearing and determination of the matter.
He says the termination of his contract was malicious, adding that the accusations labelled against him are not true. He says he was called for a normal appraisal meeting when he was forced to resign, failing which disciplinary action would be taken against him.
When Mbugua did not resign, a letter terminating his services followed and recruitment to fill his position began. He says he was accused of underperformance that brought losses to the company, without explanation of how his performance affected KQ.
In the replying affidavit, KQ through its chairman, has denied the claims by Mbugua, saying evaluation was being carried out at all managerial positions.
Justice Monica Mbaru will make a ruling for further orders on April 29.
